Terms of Service

1. Acceptance of Terms

By accessing or using ShellSense ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ShellSense provides environmental monitoring for aquaculture operations, including real-time salinity, temperature, and water level data from field-deployed sensors. The Service includes a web dashboard, SMS alert notifications, and data trend analysis.

3. Account Registration

To access certain features, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes related to aquaculture monitoring. You may not:

  • Attempt to gain unauthorized access to other users' data or accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to transmit spam or unsolicited messages
  • Reverse engineer or attempt to extract source code from the Service
  • Use automated tools to scrape or collect data from the Service

5. Sensor Data

Sensor data collected by your registered devices is stored in our systems. You retain ownership of the data generated by your devices. We may use aggregated, anonymized sensor data for research, product improvement, and general reporting purposes.

6. SMS Alerts

By enabling SMS alerts, you consent to receiving text messages at the phone number you provide. You are responsible for any charges from your mobile carrier. Alert delivery depends on third-party SMS providers and mobile network availability. We do not guarantee delivery of any specific message.

You may opt out of SMS alerts at any time by removing your phone number from your account settings or removing devices from your monitored list.

7. No Guarantee of Accuracy

Sensor readings, environmental data, tide predictions, and alert notifications are provided on an "as-is" basis. While we strive for accuracy, we do not guarantee that data will be error-free, complete, or available at all times. Hardware malfunctions, network outages, and environmental conditions can affect data accuracy and delivery.

Do not rely solely on ShellSense for critical decisions regarding livestock safety, harvest timing, or regulatory compliance. Always use multiple data sources and your professional judgment.

8. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, ShellSense and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of livestock, loss of revenue, or environmental damage, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ShellSense and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Intellectual Property

The ShellSense name, logo, website design, and software are our intellectual property. You may not use our branding without written permission. Your sensor data remains yours.

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time. Upon termination, your profile data and alert settings will be permanently removed.

13. Modifications

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email or a notice on the website.

14. Governing Law

These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict of law provisions.
